PROMOTION SUMMARY

The July Side by Side Giveaway Promotion offers participants the chance to win a Can-Am Maverick X3 DS and Voyager Echo Advantage Trailer by earning entries in tavern by playing with their True Rewards® card.

Promotion will run from 12:01am July 1, 2024 through 11:59pm July 31, 2024.

PROMOTION PRIZE CLAIM PROCEDURE

• One (1) winner will be electronically selected from all qualifying entries.
• Winner will be electronically selected on or about Thursday, August 1, 2024.
• Winner will receive a Can-Am Maverick X3 DS and Voyager Echo Advantage Trailer
• In lieu of side by side and trailer, guest may choose from one of the alternative options:
  • A $30,000 credit to use toward another item at Factory LV Powersports
  • $20,000 cash option
• No True Rewards point exchange is available.
• ARV of Can-Am Maverick X3 DS and Voyager Echo Advantage Trailer MSRP is approximately $32,000.
• Winner will be notified via email, phone, or directly by the PT’s Tavern from which the winning entry was drawn.
• Winner must provide a completed prize claim form and completed W-9 when claiming their prize.
• Winner has 7 days from date of winner notification as outline above to claim their prize. Prizes not claimed during the allotted time will become null and void and will not be awarded.

Player Entries

• Participants will receive an electronic entry for every 50 base points earned while playing with their True Rewards® card.
• Participants must be 21 years of age promotion or older and possess a valid government-issued ID to claim any prize.
• One prize per participant per contest.
• The winner agrees that he/she is accepting, operating or using the Equipment given by Golden Tavern Group, LLC (“GTG”) at his/her own risk. The winner agrees that he/she voluntarily participating in all activities related to the acceptance, operation, or use of the Equipment, and assumes all risk of claims, injury, illness, death, damage or loss that might result, including but not limited to, risk of injury, illness, death or loss due to (operation, collision, fire, carbon monoxide poisoning, strike and/or any and all other risks associated with and/or arising out of the use of said Equipment) even if the risk or damage arise out of the negligence or fault of GTG.
• The winner acknowledges, understands and agrees that neither PepsiCo, Inc., Pepsi-Cola Company and its bottlers, GTG, nor any of its affiliates, parents, subsidiaries, agents or contractors (collectively referred to herein as GTC, or Golden Tavern Group, LLC), shall be liable for any damages arising from claim, injury, damage, or personal injuries of any kind, including death, sustained by the undersigned or any person using the Equipment, as a result of any and all activities related to the operation, or use of Equipment. The undersigned assumes full responsibility for any such claims, injuries or damages which may occur, and further agrees that GTG shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that GTG shall not be responsible for such claims, injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY GTG, whether such negligence is present at the awarding of prize or takes place in the future.
• The winner hereby agrees that he/she will indemnify and hold harmless PepsiCo, Inc., Pepsi-Cola Company and its bottlers, GTG for all claims, damages, personal injuries, property damages, or any other damages themselves or to any and all third parties, including, but not limited to, operators of and passengers on Equipment, including minor children, as a result of any and all activities and/or risks related to the acceptance, operation or use of Equipment even if such damages arise out of the negligence or fault of GTG.
• PT’s Taverns reserves all rights, including but not limited to the rights to: (a) disqualification for tampering with the operation of this Promotion, (b) acting in violation of these rules, (c) acting with the intent to disrupt or undermine the legitimate operation of this Promotion, and (d) modify, suspend or terminate this Promotion without advance notification to Participants, for any reason and including (without limitation) if PT’s Taverns determines, in its sole discretion, that this Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Promotion as contemplated in these rules.
• By participating in this Promotion, Participants acknowledge and agree to be bound by these rules and that he/she will not cheat, attempt to cheat, or otherwise interrupt or attempt to interrupt or harm the operation of any PT’s Taverns service or Promotion.
• PT’s Taverns is not responsible for any human or other error, computer or other technical malfunctions, lost or delayed data or transmission, omission, interruption, deletion, defect, failures of any software or any other error or malfunction, including (without limitation) lost, interrupted, inaccessible or unavailable networks, servers, Internet service providers, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, cable or telephone transmission; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
• Any dispute related to this Promotion shall be resolved by PT’s Taverns management. Any such dispute not resolved to the satisfaction of the parties shall be referred to the Nevada Gaming Control Board pursuant to NRS 463.362.
• Should PT’s Taverns believe that a Participant has engaged, or attempted to engage, in any act to cheat, use automated technology or otherwise unfairly alter a score, credits, winning a Promotion, or to otherwise commit fraud, PT’s Taverns may disqualify that Participant, and all prizes for that Participant shall be forfeited.
• Winners are solely responsible for all state and federal taxes or other fees/penalties incurred from prizes and will be subject to a W2-G or 1099, if applicable. Participants with cumulative annual winnings valued at over $600 will receive a 1099. Winners agree to promptly and timely provide all information reasonably requested by management in connection with local, state and federal tax reporting.
• Employees of Golden Entertainment, Inc. and its affiliates, as well as immediate family members or anyone residing in the same household of said employee, are not allowed to participate in this Promotion.
• By participating in this Promotion, all winning Participants consent to the use of their name, photograph and likeness for promotion by PT’s Taverns and any of their affiliates, including but not limited to: internet, radio, television, mailers, flyers, and in-house advertising, without compensation.
• Management reserves all rights, subject to applicable laws and regulations.
